1. Acceptance of Terms
These Terms and Conditions ("Terms") govern your use of the Nalini Australia website located at nalini-3323.myshopify.com and all purchases made through it. By accessing our website, browsing our products, or placing an order, you confirm that you have read, understood, and agree to these Terms.
If you do not agree to these Terms, please do not use our website or make a purchase. We reserve the right to update these Terms at any time. Changes take effect immediately upon posting to the website.

Nalini Australia Pty Ltd (ABN 41 278 893 755) is the exclusive authorised distributor of Nalini cycling apparel in Australia. Nalini is an Italian brand founded in 1965 and manufactured in Italy. Our registered business address is 29a Campbell Street, Brighton VIC 3186, Australia.

3. Products & Pricing
3.1 Product Descriptions
We make every effort to display products accurately, including colours, measurements, and materials. However, the actual appearance of products may vary slightly from images due to photography conditions and screen calibration. We do not warrant that product descriptions are completely accurate, current, or free of errors.
3.2 Pricing & GST
All prices displayed on this website are in Australian Dollars (AUD) and include Goods and Services Tax (GST) at 10% unless otherwise stated. Prices are subject to change without notice. We reserve the right to correct pricing errors.
3.3 Availability
Products are subject to availability. We reserve the right to limit quantities or discontinue any product at any time without prior notice. If an item you ordered becomes unavailable after payment, we will notify you promptly and provide a full refund.
3.4 Italian Sizing
Nalini uses Italian sizing. Australian customers should typically size up 1–2 sizes. Please refer to our size guide before purchasing. We strongly recommend consulting the guide as sizing-related exchanges may be subject to conditions outlined in Section 8.
4. Orders & Payment
4.1 Placing an Order
By placing an order you represent that you are at least 18 years of age and have the legal authority to enter into a binding contract. An order constitutes an offer to purchase; acceptance occurs when we send you an order confirmation email.
4.2 Payment
Payment is required in full at the time of ordering. We accept major credit cards (Visa, Mastercard, American Express), PayPal, and other payment methods displayed at checkout. All transactions are processed securely via encrypted payment gateways. We do not store your full card details.
4.3 Order Cancellation
You may request cancellation of an order before it is dispatched by contacting us immediately. Once an order has been dispatched it cannot be cancelled; you will need to follow our returns process.
4.4 Fraud Prevention
We reserve the right to cancel any order we reasonably believe to be fraudulent, to cancel repeat orders from customers who have previously returned items without cause, or to refuse service at our discretion.
5. Delivery
Please refer to our Shipping Policy for full details on delivery timeframes, carriers, tracking, and international shipping. By placing an order you agree to the terms of that policy.
Risk of loss and title to goods passes to you upon delivery to your nominated address. We are not responsible for loss, theft, or damage occurring after delivery.
6. Consumer Guarantees (Australian Consumer Law)
Our products come with guarantees that cannot be excluded under the Australian Consumer Law (ACL), Schedule 2 of the Competition and Consumer Act 2010 (Cth). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
Under the ACL, our products must be:
- Of acceptable quality — safe, durable, free from defects, and fit for their normal purpose;
- Fit for any specific purpose you made known to us before purchase;
- Matching their description, sample, or demonstration model;
- Accompanied by full title and undisturbed possession.
Nothing in these Terms limits or excludes these statutory guarantees. Where we are permitted by law to limit our liability for a breach of a guarantee, our liability is limited (at our option) to: replacement or repair of the goods, or repayment of the cost of replacement or repair.

8. Sizing & Fit
Nalini garments are manufactured in Italy using Italian sizing standards. These differ significantly from Australian sizing. We prominently display a sizing warning throughout our website and strongly advise all customers to review our size guide prior to purchase.
We offer size exchanges where items are unworn, unwashed, and in original condition with all tags attached. We do not accept responsibility for incorrect sizing where the customer has declined to review the size guide and the product conforms to its stated Italian size specifications.
9. Intellectual Property
All content on this website — including text, images, logos, graphics, and design — is owned by or licensed to Nalini Australia Pty Ltd or Nalini SpA (Italy) and is protected by Australian and international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, or create derivative works from any content on this site without our express written permission. Personal, non-commercial use (e.g. saving a product image for your own reference) is permitted provided you do not remove any copyright notices.
10. Limitation of Liability
To the maximum extent permitted by law, Nalini Australia's total liability to you for any claim arising from the use of this website or a purchase shall not exceed the amount you paid for the relevant order.
We are not liable for: indirect, incidental, or consequential losses; loss of profit or revenue; loss caused by third-party carriers or payment processors; website downtime or technical errors; or loss resulting from your failure to follow product care or sizing instructions.
Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law that cannot be excluded by agreement.

12. Governing Law
These Terms are governed by the laws of the State of Victoria, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of that State and the Federal Courts of Australia for the resolution of any dispute.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.
